§ 1. Introduction
The following regulations apply to all orders placed via the https://sofart.pl portal, which is an online store (hereinafter: Store).
Whenever these Regulations refer to:
Store - it ought to be understood as the online store located at https://sofart.pl through which you can purchase the Seller's goods • Sellers - it ought to be understood as: JAN-ART Sp. z o.o. with headquarters at 63-630 Rychtal, ul. Namysłowska 26, Poland, entered into the National Court Register kept by the District Court Poznań - Nowe Miasto and Wilda in Poznań, IX Commercial Division of the National Court Register, Poland, under KRS number 0000637371
Goods - it ought to be understood as all products sold through the Store,
Buyers - it should be understood as natural persons with full legal capacity, as well as legal persons and organizational units without legal personality to which the Civil Code grants legal capacity.
Consumer - it should be understood as a natural person who performs a legal transaction with an entrepreneur not directly related to his business or professional activity, in accordance with Art. 221 of the Civil Code.
§ 2. Administrator
The administrator and owner of the https://sofart.pl portal is JAN-ART Sp. z o.o. with headquarters at 63-630 Rychtal, ul. Namysłowska 26, Poland, entered into the National Court Register kept by the District Court Poznań - Nowe Miasto and Wilda in Poznań, IX Commercial Division of the National Court Register, Poland, under KRS number 0000637371
§ 3. Rules for using the internet portal
Registration in the online store is optional. The user may place an order without registering in the store, after reading these regulations and accepting them.
The administrator may deprive the user of the right to use the online store, and may limit his access to some or all of the online store's resources, with immediate effect, in the event of violation of the regulations by the user, and in particular when the user: online shop data that is untrue, inaccurate or out of date, misleading or violating the rights of third parties, will engage in other behavior that will be considered inconsistent with applicable law or general principles of using the Internet or harming the good name of the owner of the website https://sofart.pl
A person who has been deprived of the right to use the online store may not make repeated purchases as well as registration.
In order to ensure the security of data transmission in connection with purchases made in the store, the Administrator takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent the acquisition and modification of personal data sent on the Internet by unauthorized persons.
The user is obliged in particular to: use the online store in a manner consistent with the provisions of the law in force in Poland, the provisions of the regulations, as well as the general principles of using the Internet.
§ 4. Purchase procedure
The presentation of the goods available in the online store does not constitute a commercial offer under applicable law.
Photographs presenting individual goods are the property of the Producers and are only illustrative material. The administrator mentioned in §2 of the Regulations has the appropriate permission to use them for commercial purposes. The administrator mentioned in §2 of the Regulations is not the Producer of the offered goods, but only the Agent - the Seller
In order to make a purchase via the online store, go to the website, select the goods, taking further technical steps based on the messages displayed to the user and the information available on the website. The choice of goods ordered by the user is made by adding them to the basket.
When placing an order - until the button confirming the order is pressed - the user can modify the entered data and change the selection of goods.
Sending an order by the user containing the name and surname, e-mail address, telephone number, residence address and, optionally, tax identification number (NIP) to issue a VAT invoice, constitutes a declaration of will to conclude with JAN-ART Sp. z o.o. sales contract, in accordance with the regulations. After placing the order, the user receives an e-mail containing all the essential elements of the order. The message is both confirmation of the order and conclusion of the sales contract.
If the payment in the PayU system or by bank transfer is selected, the contract is concluded at the moment of confirming the direct debit placed in this system or when the funds are credited to the bank account of JAN-ART Sp. Z o.o.
§ 5. Subject of the contract
The subject of the purchase and sale agreement is the purchase of Goods in the online store's assortment.
The online store contains new goods. All prices are given in Polish zlotys and include the tax on goods and services (VAT). The price given in the store is the final amount to be paid by the Buyer, except where the Buyer has made individual modifications to the Goods.
The dimensions of upholstered furniture presented in the offer may differ from the actual dimensions of the Goods by approx. +/- 5 cm.
§ 6. Payment
The https://sofart.pl portal offers the following payment methods:
- PayU
The User may pay for the order via the PayU website. As a rule, payment does not require registration on this website, but requires confirmation
direct debit and providing the data required by the PayU portal. By placing an order, the user is redirected to the PayU website, where he makes the payment. Then it automatically returns to the store to complete the order.
- Payment upon delivery of the goods on delivery - The Seller does not charge additional fees for using this form of payment.
